1. Introduction and Acceptance
Welcome to TinyParty Makers. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website at tinypartymakers.com.au or engaging our event planning services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
TinyParty Makers is a professional children's event planning and organization company located at 102 Queen St, Brisbane QLD 4000, Australia. We specialize in creating unique, memorable celebrations for children and families throughout the Brisbane region and beyond.
These Terms constitute a legally binding agreement between you (the "Client" or "User") and TinyParty Makers (the "Company," "we," "us," or "our"). We reserve the right to update, modify, or change these Terms at any time without prior notice. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
2. Service Description
TinyParty Makers provides comprehensive children's event planning and organization services, including but not limited to:
- Themed birthday party planning and execution
- Creative workshops and educational activities for children
- Entertainment coordination including performers, magicians, and character appearances
- Venue decoration, setup, and teardown services
- Catering services and food arrangement for children's events
- Custom party packages tailored to individual client needs
- Event consultation and planning advisory services
All services are subject to availability and must be booked in advance. Service descriptions on our website are general in nature, and specific service details will be outlined in individual service agreements or contracts.
3. Booking and Reservations
3.1 Booking Process
To book our services, clients must complete our booking form or contact us directly via phone or email. All bookings are subject to availability and confirmation from TinyParty Makers. A booking is only confirmed once we have received a signed service agreement and the required deposit payment.
3.2 Deposit Requirements
A non-refundable deposit of 30% of the total service cost is required to secure your booking. This deposit must be paid within 7 days of receiving the service agreement. Failure to pay the deposit within this timeframe may result in cancellation of your booking.
3.3 Final Payment
The remaining balance must be paid in full no later than 7 days before the scheduled event date. Events will not proceed if final payment has not been received by this deadline. We accept payment via bank transfer, credit card, or other methods as specified in your service agreement.
4. Cancellation and Refund Policy
4.1 Client Cancellations
If you need to cancel your booking, please notify us in writing as soon as possible. Cancellation fees apply as follows:
- More than 30 days before event: Deposit forfeited, remaining balance refunded
- 15-30 days before event: 50% of total cost charged
- 7-14 days before event: 75% of total cost charged
- Less than 7 days before event: 100% of total cost charged (no refund)
4.2 TinyParty Makers Cancellations
In the unlikely event that we need to cancel your event due to circumstances beyond our control (such as severe weather, illness of key staff, or force majeure), we will provide a full refund of all payments made. We are not liable for any additional costs or damages incurred as a result of such cancellations.
4.3 Rescheduling
Event rescheduling is subject to availability and must be requested in writing at least 14 days before the original event date. Rescheduling fees may apply depending on timing and availability.
5. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your event requirements, including number of guests, ages of children, venue details, and any special needs or allergies
- Ensure the venue is accessible and suitable for the planned activities
- Obtain necessary permissions and permits for the event venue
- Provide adequate supervision of children during the event in conjunction with our staff
- Inform guests of event details, timing, and any safety requirements
- Notify us immediately of any changes to event details or guest numbers
- Ensure respectful treatment of our staff and vendors
6. Liability and Insurance
6.1 Our Liability
TinyParty Makers maintains appropriate public liability insurance. However, our liability is limited to the total amount paid for our services. We are not liable for any indirect, consequential, or special damages arising from our services.
6.2 Client Liability
Clients are responsible for any damage to venues, equipment, or property caused by guests or participants at their event. Parents and guardians are responsible for the supervision and behavior of their children during events.
6.3 Third-Party Vendors
We work with trusted third-party vendors (entertainers, caterers, etc.). While we carefully select our partners, we are not liable for their actions or services beyond our reasonable control.
7. Health and Safety
The health and safety of all participants is our top priority. We comply with all relevant Australian health and safety regulations. All clients must inform us of any allergies, medical conditions, or special needs of participants. We reserve the right to modify or cancel activities if we believe they pose a safety risk.
In case of emergency, parents/guardians authorize TinyParty Makers staff to seek appropriate medical attention for children if parents cannot be immediately contacted.
8. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of TinyParty Makers and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.
We may take photographs and videos during events for promotional purposes. By engaging our services, you grant us permission to use such media unless you specifically opt out in writing.
9. Privacy and Data Protection
We are committed to protecting your privacy and personal information. Our collection and use of personal data is governed by our Privacy Policy, which should be read in conjunction with these Terms. We comply with the Australian Privacy Principles under the Privacy Act 1988.
Personal information collected includes names, contact details, and event preferences. This information is used solely for providing our services and will not be shared with third parties except as necessary to deliver our services or as required by law.
10. Force Majeure
TinyParty Makers shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or pandemic situations. In such cases, we will work with clients to reschedule or provide alternative solutions.
11. Dispute Resolution
Any disputes arising from these Terms or our services shall first be attempted to be resolved through good faith negotiation between the parties. If negotiation fails, disputes shall be resolved through mediation before pursuing legal action. These Terms are governed by the laws of Queensland, Australia, and any legal proceedings must be brought in the courts of Queensland.
12. Miscellaneous
12.1 Entire Agreement
These Terms, together with any service agreement and our Privacy Policy, constitute the entire agreement between you and TinyParty Makers regarding our services.
12.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
